During the March 16th, 2021 City Council Policy Session the City Council voted on awarding a bid to Kenny Seng Construction for the amount of $4.1 Million dollars to complete Phase 5 of the Pony Express widening project. “This project will complete the phasing of the Pony Express widening between Sandpiper and Eagle Mountain Boulevard from 3 to 5 lanes. Given the increased traffic Eagle Mountain has seen, this project is expected to help traffic through this area. This project does not include improvements to the Eagle Mountain Boulevard roundabout, and there will be a separate contract for the traffic signal at Bobby Wren Boulevard.” Phase six will include the light at Bobby Wren and improvements to the City Center roundabout.
City Councilmember Melissa Clark when asked about this bid and the impact it would have on the city made the following comment, “As reported and approved in the most recent City Council meeting, Eagle Mountain City has approved the Bid Award for Pony Express widening Phase 5.
I am reassured at the commitment of both EM City Council and MAG in funding this much-needed widening of Pony Express Pkwy. In the last two years, we have also widened other sections of road, added and lengthened turn lanes, and installed stoplights at 7 different intersections throughout the city; plus 2 additional stoplights are planned to be added to the Bobby Wren and Lone Tree intersections. We will soon receive the Master Transportation Plan, which is a comprehensive study of traffic and infrastructure needs in the city. With that data, the City Council will be able to make informed decisions about which roads and intersections need improvements next. Because I am a mom and a resident in addition to serving on City Council, I am committed, like many of my fellow Council Members, to being proactive and keeping our roads and intersections safe and updated as funding permits and traffic data dictates.”
Scope of Project
The bid document gives the project description as, “Construction services including sewer maintenance and repair, roads and highways and excavation and backfill services, levee and dam construction and digging, ditching, road grading, rock stabilization, equipment rental or lease, and energy conservation.” The bid documents continue, “Widening of the existing Pony Express Parkway approximately 9,500 feet. Project includes the removal and replacement of an existing trail. Project includes the installation of storm drainpipe and construction of two detention basins.”
Project Timeline
“The Contractor shall commence work under this Contract on or before the third day after receiving written Notice to Proceed from the Engineer on behalf of the Owner and shall fully complete all work under this Contract by October 30, 2021. More specifically Bid Schedules (Items 1-40), shall be completed in the date listed above. The Contractor shall at all times during the continuance of the Contract prosecute the work with such force and equipment as are sufficient to complete it within the time segments specified.” It should be noted that there is a penalty for not meeting these dates. “Liquidated damages shall be one hundred fifty ($150) dollars per calendar day.” Liquidated damages are presented in certain legal contracts as an estimate of otherwise intangible or hard-to-define losses to one of the parties. It is a provision that allows for the payment of a specified sum should one of the parties be in breach of contract.
Funding
The total bid was $4.1 Million, but the City will not be paying the total amount. It should be noted that the project was funded by the Mountainland Association of Governments for the upcoming fiscal year. The city is only required to provide a 6.7% match. That would be approximately $275,463.47 of the total. “In the bid opening held March 9, Eagle Mountain City received 5 bids for this project. The low bidder for this project was Kenny Seng Construction. Kenny Seng was the contractor on the previous road widening project, and is currently contracted with the City for improvements to Corey Wride Memorial Regional Park. The engineer’s estimate for the project was $4,400,000. The low bid was $4,111,394.70.”
