On 8/21/2018, during the Eagle Mountain City Council meeting, the City Council voted to change the cities regulations and codes for septic tanks throughout the city. The planning commission recommended to the City Council that they approve the changes.
In previous City Council meetings, where septic tanks have been mentioned, there has usually been discussion on the impacts that having new sewer connections would have on residents who currently have septic tanks. These code changes specify what will happen, as well as give some variance to current residents that use septic tanks.
The City Council approved the changes, but they kept the minimum lot size at 1 acre as opposed to raising to two acres. The city Staff Summary included the following, “Staff was directed by the Eagle Mountain City Council to draft a code amendment to clarify that if sewer systems were brought within 300 feet of an existing septic system the property owner would not be required to connect to the City sewer system.”

- Removing all existing provisions regarding septic systems from the code, combining them into a single section (13.35), increasing organization and simplicity of the code.
- Requiring a plat note on all new subdivisions that include septic tanks, notifying owners upfront before they build that they will be required to connect to the City sewer system within 3 years if/when sewer is extended to within 300 feet of their property.
- Exempts existing property owners with septic systems from being required to connect to the sewer system so long as their septic system is working in good repair, and there is not a plat note requiring sewer connections.
Increases the minimum lot size for a septic system to 2 acres.
The City Council approved the changes, minus the last change that would increase the lot size for septic systems to 2 acres, it will remain at the 1 acre minimum lot size.
