The Eagle Mountain City Council on June 16th, 2020 will be discussing the possibility of the annexation of approximately 204.69 acres. The process of annexation will incorporate (territory) into an existing political unit such as a country, state, county, or city. In this case, the acreage will be moved from the jurisdiction of Utah County to that of Eagle Mountain. Eagle Mountain City code specifies that the City Council is responsible to “Review and approve annexation petitions, master development plans and accompanying annexation or master development plan agreements.” The Public Notice for the June 16th meeting contains the following verbiage for item 15.A: ” A petition for the Butterfield Annexation was submitted to the Recorder’s Office on June 3, 2020. The annexation is approximately 204.69 acres and is located directly west of the Arrival subdivision, Utah County Parcels 58:044:0011 & 58:044:0012. The first action for consideration is the acceptance or denial of the petition by the City Council. This will begin the 30-day review period for certification, after which the annexation will be noticed to interested parties and may be approved by the City Council at a future meeting.”
The General Plan shows that the area of the annexation is slated to be Parks and Open Space. The petition for Annexation states that the requested zoning would be Agricultural/Rural Density Two. This zoning type according to city code would include two different zoning types (RD1 and RD2):
1. Zone: RD1. The RD1 zone is for large-lot residential developments that preserve open space, animal rights, a semi-rural character, and provide a proper transition from large lots, hillsides, or other natural areas to more suburban neighborhoods. The minimum lot size is one acre (43,560 square feet). 2. Zone: RD2. The RD2 zone is for single-family large lots in traditional suburban neighborhoods with parks, trails, and other open space. The minimum lot size is one-half acre (21,780 square feet).
The Annexation Contact Sponsor listed in the petition is Scenic Development Inc of Bluffdale, Utah. Scenic Development Inc is a domestic for-profit corporation that registered with the State of Utah on 3/23/1999. Their business name was renewed on 4/3/2020 and is valid until 3/31/2021. The registered agent is Kim W. Rindlisbacher. The address listed on the petition and the state’s website are the same address. NAICS Code: 2332 NAICS Title: 2332-Residential Building Construction. The petition was signed by Jay and Kelly Butterfield of Riverton, Utah. The State shows the parcels as being currently owned by Shirley Butterfield LTD, which has been the owner since 2017. Shirley Butterfield was listed as the owner from 2017 to 1990 when the parcels were divided from a larger plot of land. Shirley Butterfield LTD was created in 12/30/2015 and has Jay Butterfield listed as the registered agent.
As the agenda item states, this is the first step the city has to take for the Annexation process. The City Council will vote on acceptance or denial of the petition that was filed with the Recorder’s Office on June 3rd. Then there will be a 30 day period of time where the annexation will be reviewed and notice will be sent out to those who need to be notified according to city and state code. After that, the item will be brought back to the City Council for public input and a public meeting. The City Council is the land-use authority in the case of annexations so it will not be going to the Planning Commission for review.
