Ranches HOA files court documents to have court reconsider, and clarify ruling.
The Ranches HOA on May 11th, filed a motion in the Fourth District Court in Utah County to have the court rule on the manner of the payout for the judgement. The original ruling documents can be found on this post, Eagle Mountain Ranches HOA loses millions in lawsuit. The motion that was filed, has the following conclusion, “For the reasons set forth above, the Master Association respectfully requests that the Court reconsider, in part, and clarify the Ruling by directing specifically how the Association should pay the judgement.”
They are using the following reasons: Whether it is appropriate to reimburse payments to any party other than the party who made the Payments; Whether it is appropriate to pay damages to any party other than the party who incurred them; Whether it is appropriate to use monies held in statutorily mandated reserves to pay damages; and What the most appropriate way is to distribute the master association’s limited assets. The Sub-HOAs that are supposed to receive the payments for the original judgement are working on an open letter to the three sub-HOAs residents. The response from the Sub HOAs is included below. It contains a call to action for all residents in the sub-HOAs to contact the Ranches HOA board and let them know that they want them to stop wasting money by continuing litigation. “Call To Action – Reach out to th Ranches Board now and tell them to quit spending our money to litigate and settle now under the agreement proposed by the plaintiffs.”
